Death-knell Doctrine是什么意思？

Death-knell Doctrine，也称Death-knell Exception。指“丧钟原则”。根据这一原则，对法庭作出的中间命令〔interlocutory order〕，如果须等到终局判决的作出方可上诉，将会使争点在上诉审中变成无实际意义的问题〔moot the issue〕，并将会对上诉人的实体权利造成不可弥补的损害，则允许在作出终局判决之前对之提起中间上诉。
